SB 1088 is aimed at eroding the rights and protections of California rank-and-file officers by severely limiting the labor protections ensured by the Public Safety Officers Procedural Bill of Rights (POBR). This would make it significantly easier to discipline rank-and-file officers and threatens the procedures POBR has put in place to maintain stable employer-employee relationships and ensure more productive conflict resolution.

POBR provides labor and procedural protections to officers to ensure that investigations into and disciplinary actions against officers are fair, productive and transparent. This includes protections against retaliation from supervisors and an officer’s right to know if any complaints have been made against them. If passed, the effects of SB 1088 would negatively impact officer morale and the retention of top talent.

Whether you are a police chief or a rookie officer, the current process is the same for everyone, and that buy-in from law enforcement ensures that whether an officer is found to have committed misconduct or is proven innocent, all parties can accept the outcome, increasing the efficacy of corrective action. This fundamental labor protection that has been in place since 1977 is now being threatened by SB 1088.
